Mind86 Terms of Use

These terms are an agreement between you and Mind86, operated by Ahmed Hendi in Riyadh, Saudi Arabia ("Mind86", "we", "us"). They apply to the Mind86 apps and the mind86.com website (the "Service"). By creating an account or using the Service, you agree to these terms. If you do not agree, do not use the Service.

Our Privacy Policy at https://mind86.com/privacy explains how we handle your personal information.

1. Who can use Mind86

You must be at least 14 years old to use Mind86. When you create an account we ask for your birth month and year to check this. If you are under the age of majority where you live, you may use Mind86 only with the permission of a parent or guardian, who agrees to these terms for you. We may close an account if we learn that its owner is under 14.

2. Your account

You are responsible for keeping your sign-in details private and for activity on your account. Tell us at iahmedhendi@gmail.com if you think someone else has used your account. You can delete your account at any time in the app (the Account icon in your library, then Delete account) or at https://mind86.com/account/delete.

3. The Service is free

Mind86 is currently free. If we ever introduce paid features, we will tell you the price and terms before you are charged.

4. Your books and content

You keep all rights you have in the books, notes and other content you add ("Your Content"). You give us permission to store, copy, process and display Your Content only as needed to run the Service for you, including extracting text, running OCR and generating quizzes, summaries, flashcards and maps. This permission ends when you delete the content or your account, except for copies we must keep to comply with the law.

Your books are private to your account. Mind86 does not share them with other users.

5. Only add files you have the right to use

Only add books and files that you own or have the right to use in this way. Do not add content that infringes anyone's copyright or other rights, or that is illegal.

6. Copyright complaints and repeat infringers

We respect copyright. If you believe content in Mind86 infringes your copyright, send a notice to iahmedhendi@gmail.com with:

  1. your name, address, phone number and email address;
  2. a description of the copyrighted work;
  3. enough information for us to identify the content in question (for example the account email address or book title, if you know it);
  4. a statement that you believe in good faith that the use is not authorized by the copyright owner, its agent or the law;
  5. a statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act for the owner; and
  6. your physical or electronic signature.

We may remove or disable access to content that is the subject of a notice, and we will tell the affected user. If you believe your content was removed by mistake, you may send us a counter-notice to the same address explaining why.

We will terminate, in appropriate circumstances, the accounts of users who repeatedly infringe copyright.

Quizzes, summaries, flashcards and mind maps are generated by software from your book's text. They can be incomplete or wrong. They are study aids, not professional, medical, legal or financial advice. Check important points against the book.

9. Our rights

The Mind86 apps, website, design and software belong to us or our licensors. We give you a personal, non-exclusive, non-transferable, revocable license to use the Service under these terms. App store terms (Apple or Google) also apply to your download of the app.

10. Changes to the Service and these terms

We may change, suspend or stop any part of the Service. We may update these terms; we will post the new version on this page with a new effective date, and tell you in the app or by email before a significant change takes effect. If you keep using the Service after a change takes effect, the new terms apply.

11. Ending your use

You can stop using Mind86 and delete your account at any time. We may suspend or close your account if you break these terms, if the law requires it, or to protect users or the Service. Sections 4 (for copies kept to comply with the law), 8, 9, 12, 13 and 14 continue after your account ends.

12. No warranties

To the extent the law allows, the Service is provided "as is" and "as available", without warranties of any kind, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Service will be uninterrupted or error free, or that content will be kept forever. Keep your own copies of your files.

13. Limitation of liability

To the extent the law allows, Mind86 is not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill. Our total liability for any claim about the Service is limited to 100 US dollars. Some places do not allow these limits, so they may not apply to you. Nothing in these terms limits rights you have under consumer protection laws that cannot be waived.

14. Apple

If you downloaded Mind86 from the Apple App Store, Apple is not a party to these terms and is not responsible for the app or its content, and Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them. Apple has no obligation to provide maintenance or support for the app.

15. Language

A French version of these terms is available at https://mind86.com/fr/terms. If you are in Quebec, the French version was offered to you first; if you chose to accept these terms in English, you expressly chose to be bound by the English version.
